However, our legal system is set up in such a way where monetary damages is not only a way to compensate persons for lost wages, medical bills, and pain and suffering; it is also there as a way to hold doctors accountable for their actions. Without the threat of monetary sanctions and lawsuits, doctors would lose some motivation for conducting their professional lives in a careful and cautious manner. Furthermore, if you doctor did negligently injure you or a loved one, bringing suit against him may serve as a wakeup call and could possibly prevent him from injuring someone else in the future.
Some state courts still use the Frye test that relies on scientific consensus to assess the admissibility of novel scientific evidence. Daubert expressly rejected the earlier federal rule's incorporation of the Frye test. (Daubert, 509 U.S. at 593-594) Expert testimony that would have passed the Frye test is now excluded under the more stringent requirements of Federal Rules of Evidence as construed by Daubert.

I disagree with moviedoc. It most certainly was relevant to the patient. If a patient does not give informed consent to a procedure and you do the procedure anyway it's called assault. The patient did not give informed consent. She agreed based on deceitful information. That's not informed consent. He could have said, "I don't have to answer those questions, it's not your business." That's certainly his right. It's not his right to lie to the patient so they'll sign the consent form so he can make money.
When the provincial health insurance plans were first created in the 1960’s and 1970’s, the federal government paid for about half of the provincial plans’ costs.  This percentage fell by more than half in the 1990’s, but has gone back up somewhat in recent years.[4]  The provincial contributions to the plans are also mostly from general revenues.  However, the largest province, Ontario, and a couple of other provinces also impose a levy on employers to help pay for their programs.
Many litigants facing civil lawsuits in which the United States is the plaintiff have erroneously sought to counterclaim against the U.S. The United States, however, to this date has not waived sovereign immunity for claims for damages, (See United States v. Northside Realty Associates, 324 F.Supp. 287, 291 (N.D. GA 1971) (dismissing a counterclaim asserted against the Attorney General where plaintiff in the suit was the United States on the ground that although the suit was initiated by the Attorney General, the real party in interest was the United States).
In response to rising malpractice suits, many states pushed for "tort reform" measures. Such measures limit the amount of damages a patient can recover for noneconomic losses, such as pain and suffering, and Punitive Damages. For example, in 1975, California enacted the Medical Injury Compensation Reform Act, which limits recovery of noneconomic damages at $250,000 and restricts the amount of fees that may be recovered by lawyers. Several other states adopted similar measures based on the California model.

I disagree about it being an issue of "personal background." Whether or not the doctor had previously lost patients from that procedure, and whether or not he had had action taken against him is professional background, not personal. "Personal" implies that it affects only the private life of the individual in question. Just because something could go wrong no matter how skilled the surgeon doesn't justify lying about the outcome of prior surgeries, especially given that the patient directly asked. It wasn't a lie of omission, it was a flat-out lie about something that the patient clearly considered important information to their decision about the surgery.

These critics assert that these rate increases are causing doctors to go out of business or move to states with more favorable tort systems.[30] Not everyone agrees, though, that medical malpractice lawsuits are solely causing these rate increases.[31] A 2003 report from the General Accounting Office found multiple reasons for these rate increases, with medical malpractice lawsuits being the primary driver.[32] Despite noting multiple reasons for rate increases, the report goes on to state that the "GAO found that losses on medical malpractice claims-which make up the largest part of insurers’ costs-appear to be the primary driver of rate increases in the long run." More recent data has indicated that medical malpractice rates are generally no longer rising. In 2011, data pooled from the industry by the publication Medical Liability Monitor indicated that medical malpractice insurance rates had declined for four straight years. The decrease was seen in both states that had enacted tort reform and in states that had not, leading actuaries familiar with the data to suggest that patient safety and risk management campaigns had had a more significant effect.[33]

In 2013, BMJ Open performed a study in which they found that "failure to diagnose" accounted for the largest portion of medical malpractice claims brought against health professionals. Furthermore, the study found that the most common result of this negligence was death of the patient.[9] The other most common categories of malpractice include negligent treatment and failure to warn.

Doctors typically require patients to sign a consent form detailing the risks of any given treatment or procedure. But signing a form alone does not necessarily prove that the patient gave informed consent. The doctor must actually discuss the procedure and risks with the patient. And the patient must understand, to the extent possible, the risks he or she faces.
Currently, most states have legal precedents that establish an informed consent standard. For instance, in Cobbs v. Grant, 8 Cal.3d 229, 104 Cal. Rptr. 505, 502 P.2d 1 (1972), the California Supreme Court first introduced the premise as “a duty of reasonable disclosure of the available choices with respect to proposed therapy and of the dangers inherently and potentially involved in each.” The Court further defined the physician’s duty in Truman v. Thomas, 27 Cal.3d 285, 611 P.2d 902 (1980), by stating that doctors must also inform patients of all material risks a reasonable person would want to know if deciding not to undergo a treatment or procedure. In other words, if certain information would be relevant to a patient’s understanding of and course of action in regards to a current condition, treatment or procedure, the doctor must share that data with the patient—to not do so would be considered lying as well as illegal.
